1. Acceptance of Terms

By accessing and using FlexyGift ("the App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

FlexyGift is a mobile application that allows users to send gifts, messages, and personalized content to recipients in Ghana. The App facilitates:

• Selection and purchase of gifts from verified vendors
• Sending personalized messages, photos, videos, and audio recordings
• Delivery of gift vouchers via SMS or in-app notifications
• Redemption of vouchers at vendor locations
• Communication between users through messaging features

3. User Accounts

To use certain features of the App, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Payments and Refunds

All payments are processed securely through Mobile Money (MTN, Telecel, AirtelTigo) with OTP verification. By making a purchase, you agree to:

• Pay the full amount displayed at checkout
• Accept that all sales are final unless otherwise stated
• Understand that refunds are subject to vendor policies and our refund policy
• Accept that processing fees may apply to refunds

5. Gift Delivery and Redemption

Gifts are delivered as vouchers that can be redeemed at vendor locations. You understand that:

• Vouchers may have expiration dates as specified by vendors
• Recipients must present the voucher code at the vendor location to redeem
• Vouchers are non-transferable unless otherwise stated
• We are not responsible for vendor availability or product availability at time of redemption

6. User Content

You retain ownership of all content you upload, including messages, photos, videos, and audio recordings. By uploading content, you grant us a license to:

• Store and transmit your content to deliver gifts and messages
• Display your content to intended recipients
• Use your content for service improvement and support

You agree not to upload content that is illegal, harmful, threatening, abusive, or violates any third-party rights.

7. Prohibited Activities

You agree not to:

• Use the App for any illegal purpose
• Impersonate any person or entity
• Harass, abuse, or harm other users
• Interfere with or disrupt the App's functionality
• Attempt to gain unauthorized access to the App or its systems
• Use automated systems to access the App without permission

8. Intellectual Property

The App and its original content, features, and functionality are owned by FlexyGift and are protected by international copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by law, FlexyGift shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

10. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including if you breach these Terms of Service. Upon termination, your right to use the App will cease immediately.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes via the App or email. Your continued use of the App after such modifications constitutes acceptance of the updated terms.
